1. How to calculate the number of annual leave record based on seniority?

In Article 114 of the 2019 Labor Code, there are provisions as follows:
Recording Annual Leave increase according to working seniority.
For every full 05 years of working for an employer, the employee’s number of annual leave days as prescribed in Clause 1, Article 113 of this Code is increased by 01 day.
Thus, for employees, annual leave will increase according to seniority, specifically

  • Annual leave days increase according to working seniority.
  • For every 05 years of working for an employer, the number of annual leave days of the employee will be increased by 1 day.

For example: An employee who works for 12 months under normal conditions is entitled to 12 working days of annual leave. When there are 5 or more years of work for 1 employee, the number of annual leave days increases to 13 days.

Similarly, annual leave is increased to 15 days for heavy, hazardous, dangerous work or for minor workers or disabled workers; increased to 17 days for people doing particularly heavy, toxic, or dangerous work.

2. When is the time to calculate an additional day off after 5 years?

According to Article 114 of the 2019 Labor Code Employee Annual Leave Record, for every full 05 years of working for an employer, an employee is entitled to add 01 day of annual leave to the total number of days of leave entitled.

Thus, the time to add annual leave based on seniority will be calculated as soon as the employee has worked for 5 years, 10 years, 15 years, etc. for an employer.

Specifically, when working for a business for 5 years, from the 6th to the 10th year of working there, the employee will receive 1 additional day of leave/year. Working from the 10th year to the end of the 15th year, employees are entitled to 02 additional days of leave/year. Working from the 16th year to the end of the 20th year, the employee will receive 03 additional days of leave/year…

For example, Ms. A joined company X from March 1, 2021 with normal working conditions.

During the first 5 years (from March 1, 2021 – February 28, 2026), each full 12 months of work per year, Ms. A is entitled to 12 working days off with full pay.

During the period from the 6th year to the 10th year (from March 1, 2026 – February 28, 2031), each full 12 months of work per year, Ms. A is entitled to 13 working days off with full pay.

During the period from the 11th to the 15th year (from March 1, 2031 – February 29, 2036), each full 12 months of work per year, Ms. A is entitled to 14 working days off with full pay.

Note: The working time calculated for annual leave is calculated including the employee’s probationary period (according to Clause 2, Article 65 of Decree 145/2020/ND-CP).
