1. Latest Labor Code 2024 and guiding documents?
As of 16 May 2024, the latest Labor Code currently applicable is the 2019 Labor Code, effective from January 1, 2021. Documents guiding the implementation of the 2019 international labour organization include:
- Decree No. 12/2022/ND-CP dated January 17, 2022 of the Government regulating penalties for administrative violations in the fields of labor, social insurance, and Vietnamese workers working abroad According to the Contract.
- Decree No. 38/2022/ND-CP dated March 29, 2022 of the Government regulating the minimum salary for employees working under labor contracts.
- Circular No. 09/2023/TT-BYT dated March 11, 2023 of the Ministry of Health amending Circular No. 14/2013/TT-BYT dated May 6, 2013 guiding periodic health examinations for workers.
- Decree No. 83/2022/ND-CP dated May 28, 2022 of the Government regulating retirement at higher ages for officials and civil servants holding leadership and management positions.
Some new points of the 2024 Labor Code compared to the 2012 Labor Code include:
- Expand the scope of the Labor Code to include employees working without a labor contract.
- More clearly stipulate the rights and obligations of employees and employers.
- Raise the regional minimum wage.
- Strengthen labor protection measures and occupational safety and hygiene.
- Strengthen measures to ensure workers’ rights in international labor organization.
The 2014 Labor Code has been evaluated as an important step forward in protecting the rights of workers, contributing to building harmonious, stable and progressive labor relations.

2. Retirement age according to the provisions of the Labor Law 2024?
The employee’s retirement age in 2024 will still comply with the provisions of Article 169 of the 2019 Labor Code. Specifically, the employee’s retirement age will depend on the employee’s working conditions, in which:
– The retirement age of employees under normal working conditions is adjusted according to the roadmap until reaching 62 years old for male employees in 2028 and reaching 60 years old for female employees in 2035.
+ From 2024, the retirement age for employees under normal working conditions is 61 years old for male employees and for female employees will be 56 years and 4 months.
– Employees with reduced working ability; doing extremely heavy, toxic or dangerous occupations and jobs; doing heavy, toxic and dangerous occupations and jobs; Working in areas with extremely difficult socio-economic conditions can retire at a lower age but not more than 05 years old compared to the provisions in Clause 2, Article 169 of the 2019 Labor Code at the time of retirement, except In case the law has other provisions.
– Employees with high professional and technical qualifications and in some special cases can retire at a higher age but not more than 05 years old compared to the provisions in Clause 2, Article 169 of the 2019 Labor Code at the time retire, unless otherwise provided by law.

3. What are the rights of workers according to the provisions of the company labour rules – Labor Law 2024?
Workers’ rights under the provisions of the Labor Law 2024 are mentioned in Article 5 of the 2019 vietnam international labour rules, specifically including the following rights:
– Work; freedom to choose jobs, workplaces, occupations, vocational training, and improve professional qualifications; be free from discrimination, forced labor, and sexual harassment in the workplace;
– Receive salary appropriate to qualifications and vocational skills on the basis of agreement with the employer; have labor protection, work in conditions that ensure occupational safety and hygiene; Leave according to the regime, paid annual leave and enjoy collective benefits;
– Establish, join and operate in employee representative organizations, professional organizations and other organizations according to the provisions of law; request and participate in dialogue, implement democratic regulations, collective bargaining with employers and be consulted at the workplace to protect their legal and legitimate rights and interests; Participate in management according to the employer’s internal regulations;
- Refuse to work if there is a clear, direct threat to life and health during work performance;
- Unilateral termination of labor contracts;
- Strike;
- Other rights as provided for by law.
