Conditions to apply for a high-tech enterprise certificate
In the context of the development of the digital technology era, high-tech enterprises are always at the forefront of the integration process and bring large revenues contributing to the national budget. However, being granted a High-Tech Business Registration Certificate in Vietnam is not an easy thing because there are many criteria that businesses need to meet. The article below will provide an overview of the conditions and procedures for granting High-tech Business Registration Certificates in Vietnam, thereby providing businesses and investors with important information in adjusting and developing strategies for businesses.
1. Conditions to become a high-tech enterprise
To become a high-tech enterprise, a business needs to meet the following criteria:
First, enterprises must produce high-tech products on the List of high-tech products encouraged for development. Accordingly, high-tech products encouraged for development are high-tech products created from technologies on the List and meet the following conditions:
- There is a high proportion of added value in the product value structure;
- Highly competitive and has great socio-economic efficiency;
- Ability to export or replace imported products;
- Contribute to improving national science and technology capacity.
Procedures for granting a certificate of high-tech agricultural enterprise in Vietnam
Second, the average total expenditure of the enterprise in 3 consecutive years for research and development activities carried out in Vietnam must reach at least 1% of total annual revenue, from the fourth year onwards it must reach over 1% total revenue.
Third, the average revenue of the enterprise for 3 consecutive years from high-tech products must reach at least 60% of the total annual revenue, from the fourth year onwards it must reach 70% or more;
Fourth, the number of employees of the enterprise with a university degree or higher who directly conduct research and development must be at least 5% of the total number of employees.
2. Procedures for applying for a High-tech Enterprise Registration Certificate
Step 1: Prepare 01 set of original documents and 01 set of photocopied documents
Components of an application for a High-tech Enterprise Registration Certificate include:
- Application for recognition of high-tech enterprises according to the form prescribed by the Ministry of Science and Technology;
- Notarized copy of Business Registration Certificate or Investment Certificate or Science and Technology Enterprise Certificate;
- The enterprise’s explanation has fully met the conditions prescribed in Clause 1, Article 18 of the Law on High Technology;
- Evidence of research and development activities carried out in Vietnam;
- Financial statements of the enterprise (confirmed by audit) (Note: must be a business that has been operating for at least 01 year);
- Report breaking down the costs of conducting research and development activities and revenue from high-tech products;
- Records of the workforce participating in research and development activities (list and qualifications);
- Records of quality management system;
- Records of product quality standards applied by the enterprise;
- Document explaining compliance with environmental and energy saving standards and technical regulations.
Step 2: Submit application directly or by post or through the National Public Service Portal

Step 3: The Ministry of Science and Technology collects opinions from relevant Ministries and People’s Committees
If the dossier is incomplete, the Ministry of Science and Technology must send an official dispatch requesting additional and complete dossiers to be sent directly or by post to the enterprise requesting recognition as a high-tech enterprise. Within 10 working days from the date of receiving the official request from the Ministry of Science and Technology, the enterprise applying for a High-tech Enterprise Certificate is responsible for supplementing, correcting and sending it back to the Ministry Science and technology.
In case of necessity, the Ministry of Science and Technology organizes meetings with relevant ministries, branches, and People’s Committees of centrally run provinces and cities to clarify the issues raised in the recognition application dossier high-tech enterprise.
Step 4: Appraisal and issuance of High-tech Enterprise Certificate
Within 30 days from the date of receiving the complete dossier, the Ministry of Science and Technology is responsible for evaluating and issuing a High-tech Enterprise Certificate and sending it to the enterprise. In case of refusal to issue a High-tech Enterprise Certificate, the reason must be notified in writing to the enterprise requesting recognition as a high-tech enterprise.
